1. About this site

empathynerd.com (the "Site") is operated by EmpathyNerd LLC, an Oregon limited liability company ("EmpathyNerd," "we," "us"). The Site is informational. It describes our consulting services, publishes articles, and provides ways to reach us.

By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

2. No client relationship

Nothing on the Site creates a consulting, advisory, or contractual relationship between you and EmpathyNerd. Engagements begin only under a separate written agreement signed by both parties.

3. Content is general information

Articles and other content on the Site reflect our general views on customer success practice. They are not tailored advice for your business, and we make no guarantee of any particular result from applying them. You are responsible for decisions you make based on Site content.

4. Intellectual property

All content on the Site, including text, articles, graphics, and the EmpathyNerd name and logo, is owned by EmpathyNerd LLC or its licensors. You may read, share, and quote from it with attribution and a link back to the original page. You may not republish full articles, sell the content, or present it as your own without our written permission.

5. What you send us

Please do not send confidential or sensitive material through the Site's contact form or by email before an engagement agreement is in place. Submitting information through the Site does not create a confidentiality or non-disclosure obligation on our part, though we handle everything you send us in accordance with our Privacy Policy.

6. Text messaging

Our SMS program is EmpathyNerd LLC client and inquiry messaging. We use text messaging only for operational communication with clients and people who contact us. We do not send marketing, promotional, or unsolicited messages. If you provide your mobile number and consent to receive text messages from us, the following applies:

• Messages relate to your inquiry or active engagement. Message frequency varies.

• Message and data rates may apply.

• Reply STOP to opt out at any time. Reply HELP for assistance, or email help@empathynerd.com.

• Text messaging originator opt-in data and consent will not be shared with any third parties.

• Carriers are not liable for delayed or undelivered messages.

7. Third-party links

The Site may link to third-party websites. We do not control those sites and are not responsible for their content, terms, or privacy practices.

8. Site availability and disclaimer

9. Limitation of liability

To the fullest extent permitted by law, EmpathyNerd LLC is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Site. Our total liability for any claim relating to the Site will not exceed one hundred dollars ($100).
